In February 2015, Retired Superior Court Judge Robert J. Polis awarded O&N’s client the entire amount of $545,778.58 in Cumis fees it had sought in a 2860 Arbitration against its liability insurer, Arrowood Indemnity Company, plus another $71,224.26 in prejudgment interest, for a total award of $617,002.84. Such fees were incurred by O&N’s client for work performed by its Cumis counsel in underlying environmental litigation currently pending before the United States District Court for the Eastern District of California. Concurrently, O&N is prosecuting this client’s bad faith claim against Arrowood in the same court.
